The $3k rule. Why your big loss didn’t save you.




You lost big and expected a big refund.
→ Then your CPA says, “You get to only use $3k from the loss”

Wait. What?

Here’s the problem:
→ You think a $100K capital loss wipes out $100K of income.
→ It doesn’t.
→ The IRS caps how much of that can hit your other income.

The rule:
→ Unlimited against capital gains.
→ But only $3,000 per year against non-capital income (like W2, business, rental).
→ The rest carries forward year after year.

Example:
→ You’re in a 30% bracket.
→ You lose $100K.
→ You don’t “get back” $100K.
→ You save tax on what’s allowed.
→ And you drag the rest forward.
→ That’s why your return looked underwhelming.

The strategy:
→ Use losses to offset gains in the same year when possible.
→ Track carryforwards.
→ Don’t create losses just for “tax savings” you don’t truly get.

Real players understand:
→ A loss is a tool, not a refund machine.

Most people stop here.
They accept the $3K rule, shrug, and move on.

That’s where average behavior ends.

Because the real strategy doesn’t start at the loss — it starts with what you do after it.
