✨Nieuwe publicatie over wat wél mag van de GDPR in marketing en sales ✨

De deelnemers van PrivCon (Dasprive event) kregen in oktober al een sneak peek van de inhoud.  

In onze sessie hebben we aan de hand van enkele stellingen op een positieve en pragmatische manier gekeken naar (i) wat er mogelijk is onder de GDPR en (ii) wat er juridisch verdedigbaar is. 

De deelnemers naam actief deel door voor elke stelling een rode ('oneens') of groene ('eens') kaart in de lucht te steken. Erg interessant dat er zelden unanimiteit was onder de privacy professionals.

Zonder de man met de snor was het niet gelukt. De kritische geest van Enzo Marquet was de perfecte aanvulling om dit project tot een goed einde te brengen. Wordt ongetwijfeld vervolgd!

⚖️ The Belgian Data Protection Authority has taken its first 200 decisions of 2025, and almost half of the admissible cases were dismissed.

So far, the Autorité de protection des données - Gegevensbeschermingsautoriteit dismissed at least 96 cases. The actual number could be higher, as not all decisions are published.

In 22 of the published decisions, the DPA explicitly referred to the existence of a broader underlying dispute (for example a civil or administrative procedure) that falls outside its competence. 

Other recurring reasons:
🔸Lack of evidence
🔸The issue was already resolved by the time the DPA assessed the complaint
 
It still seems like many dismissed complaints are about relatively minor GDPR issues, appearing to come from broader frustrations rather than genuine data-protection concerns. 

✅ At the same time, several controllers seem to take mitigating steps after the complaint.

This post is an update from my post on the first 100 cases (https://lnkd.in/e7csfGRE). 

⚠️ Important rectification: the analysis only covers admissible complaints, not all complaints the DPA receives. 

To put it into context, the inadmissibility rate of received complaints received:
🔹2024: 832 / 326 (~ 39%) 
🔹2023: 694 / 254 (~ 37%)
🔹2022: 567 / 248 (~ 44%)
🔹2021: 1928 / 257 (~ 13%) (1120 complaints stemmed from a Facebook data breach, after the DPA encouraged individuals to file a complaint)
🔹2020: 668 / 128 (~19%)

⏳Since it can take several years to treat a complaint, I was unable to determine how many (admissible) complaints are ultimately dismissed.

Most AI use in court is done by self-representing litigants
 
A report released by UNSW's Centre for the Future of the Legal Profession revealed that in 351 out of 520 cases across 10 jurisdictions, GenAI was used by litigants representing themselves used GenAI. In Australia alone, these parties accounted for 78% of the dataset. (https://lnkd.in/e2sQr3r6) 
 
💸 Why is this happening? The report points to the cost of legal services as a major driver. Self-representation is most common in family, migration, and employment cases.

The report highlights the danger of hallucinations, for example fake and incorrect case citations. Beyond this, I believe there is a risk that litigants may vastly overestimate their chances of success because of the confident sounding answers. 

🗣️ Cases involving legal practitioners misusing AI attract the most media attention, but the data shows that unrepresented parties account for the majority of cases. Sadly, no data on this is currently available in Belgium.

Should you be allowed to use AI for your own legal defence?

In a recent (unpublished) decision by the Court of Gembloux (Belgium), two defendants without an attorney contested the payment of their architect’s invoice.

🤖 The court noted that "their conclusions were clearly drafted with the active assistance of artificial intelligence" (see the original French extract below). 

It is unclear why the court found it necessary to mention this explicitly, as the use of AI seems irrelevant to this decision. Perhaps it did play a role in how the court assessed the arguments.

🚧 This case makes me question whether AI tools should be obligated to include stronger guardrails against unsupervised use for legal advice. The sycophantic nature of AI is one reason stronger guardrails might be needed, and it also highlights where attorneys can add value. ChatGPT's usage policy already prohibits unsupervised use for providing tailored legal advice that requires a licence, but this is likely not enough. 

However, it seems that prohibiting AI assistance for self-representation altogether might not be beneficial. In The Netherlands a labour migrant won an eviction case with the help of AI and, important distictintion, legal assistance (see the summary by Ljubiša Metikoš: https://lnkd.in/egUTjE_d) 

This leads me to my question, should you be allowed to use AI for your own legal defence?
