BREAKING NEWS: Bye Bye Tariffs!! (mostly)

The Supreme Court ruled 6-3 today that President Trump's sweeping tariffs imposed under the International Emergency Economic Powers Act (IEEPA) are unconstitutional. 

Chief Justice John Roberts wrote the majority opinion, joined by the three liberal justices plus conservatives Gorsuch and Barrett. Thomas, Alito, and Kavanaugh dissented.

What was struck down: Trump's "reciprocal" tariffs (ranging from 10% baseline to 34%+ for China) and the 25% tariffs on Canada, China, and Mexico tied to fentanyl — all imposed under IEEPA. The court held that IEEPA does not authorize the president to impose tariffs, since the Constitution gives that power to Congress.

What still stands: Tariffs imposed under other laws, like steel and aluminum duties, remain in place. The administration has signaled it will try to maintain its tariff framework using other legal authorities.

The money question: The Treasury has collected more than $133 billion from IEEPA-based tariffs. The ruling was silent on refunds, but companies like Costco have already lined up in court to demand their money back. A small business coalition called "We Pay the Tariffs" is pushing for immediate automatic refunds.

What's next: Trump could seek to reimpose some tariffs using other laws, though those carry more limitations on speed and scope. 

This is being called Trump's biggest legal defeat since returning to office, as the court had previously sided with him on most emergency docket challenges.
