HR professionals. Please, please, PLEASE stop saying "there's nothing we can do unless you make a formal complaint."


Especially when someone is reporting sexual harassment.

Do you have any idea how much courage it takes to say those words out loud? To walk into HR and describe what's been happening to you?

And then we respond by handing them a form and telling them the ball's in their court.

No.

You have a duty of care to that employee. You have a duty of care to everyone else who might be affected. And frankly, you have obligations under the Worker Protection Act that don't disappear just because someone doesn't want to go formal.

🚀 You can investigate concerns raised informally. 
🚀 You can launch a wider investigation to see if others have similar concerns. 
🚀 You can review patterns of behaviour. 
🚀 You can adjust team structures, supervision arrangements, working patterns. 
🚀 You can act.

One person coming forward is often the tip of the iceberg. How many times have you investigated a complaint only to find three other people saying "oh, that happened to me too"?

You don't have to wait for a formal grievance to ask the question.

Yes, an informal report might limit some of your options. Yes, there are complexities to navigate. But "there's nothing we can do" is almost never the honest answer.

The honest answer is "this is harder without a formal complaint" – and then you work out what you can do.

Because making someone choose between a formal grievance process and being ignored isn't a choice. It's a failure.

Helping HR consultants and in-house teams work smarter

I got something wrong this week 🫠


A few people corrected me in a Facebook group – and they were right.

It was about how the Employment Rights Act 2025 changes will work in practice. I’d conflated two related but distinct legal concepts – and stated something with confidence that wasn’t quite accurate.

Did it sting? Yes. 

Did I want the ground to swallow me? Also yes.

But here’s the thing – if you’re working in HR or employment law right now, you’re navigating the biggest legislative overhaul in a generation. The detail is dense, the guidance is still emerging and concepts that seem straightforward often aren’t once you dig into the mechanics.

I’ve been studying legal principles as part of further qualifications, and applied a general rule about retrospectivity without fully thinking through how it works in this specific context. Turns out employment law doesn’t always play by the same rules as the rest of the legal system.

Getting something wrong doesn’t make you bad at your job. Refusing to learn from it does.

If you’ve had a similar moment recently – you’re not alone. The only way through this is to keep reading, stay curious and be humble enough to accept correction.

Now if you’ll excuse me, I need to walk my dog and stop thinking about it 😅🐕

I never wanted to be a solo HR consultant – not because I can't work alone, but because I know I do better work when I've got people to bounce ideas off.


Someone to say "have you thought about..." when I'm too close to a case, a second opinion when the right answer isn't obvious, and cover when I need to step away and actually switch off.
